Text messages: how clients consent

ParaFormPrep, a service of Info-Tech Delta Computer Inc., sends text messages to people who use it to sign their immigration intake agreement and who agreed to receive texts from ParaFormPrep. The messages are about the client’s immigration case: a link to sign the intake agreement, reminders to sign it, appointment reminders, notice that a form is ready to review and sign by hand, and requests for documents. Up to 20 messages per month. Message and data rates may apply. No marketing.

1. Verbal consent, before the signing link is texted

When the client is with their preparer, the preparer reads this script before choosing to text the client a link to sign the intake agreement. The link can only be texted after the preparer confirms the client said yes; ParaFormPrep records who confirmed it, when, and the script version.

“Do you agree to receive text messages from ParaFormPrep, a service of Info-Tech Delta Computer Inc., with a link to sign your intake agreement and updates about your immigration case? Up to 20 messages a month. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time. Terms and privacy: paraformprep.com/terms and paraformprep.com/privacy.”

2. Optional checkbox on the signing page, for case updates

On the page where the client signs the intake agreement (in English or Spanish), a separate checkbox, not ticked in advance, lets the client agree to receive texts from ParaFormPrep at the mobile number they give. It is optional: the client can sign without it, and then gets no texts. The box shows the program, the frequency, “Msg & data rates may apply”, HELP and STOP instructions, and links to the Terms of Service and Privacy Policy. ParaFormPrep records the exact wording shown, the time, the IP address and the browser.
